Hello Michael, I saw the Stereophile post about this matter and remember thinking that if aggrieved parties feel the need to wash their laundry in public, they must have reached a state of last resort. It's always sad when common sense and good will aren't enough to settle disputes. Srajan
Hi Srajan, I agree that the situation is unfortunate. This lawsuit seems to go beyond a typical dispute among a distributor/manufacturer, dealer and customer. It also sheds light on the 'payola' nature of certain relationships within the audio industry. I am following the case closely because it highlights factors affecting Lumin's business even though they are not directly involved in the litigation. Ultimately I believe that the resolution of this lawsuit could be beneficial for the industry if it leads to greater transparency. Michael
I just dove a bit deeper to learn more about the payola angle. I found accusations of deliberate brand defamation, on the salesfloor and in online discussion and review fora, to strategically undermine competing brands which one had contractually agreed to represent under best business practices. It reminded me of older shenanigans whereby a region's pre-eminent dealer would sign a brand for exclusive cover in the wider area then hide the product in the basement to never promote or sell. This effectively blocked the new brand from competing with the store's golden cows whilst no other regional dealer had access to it. Signing a brand only to block it really plays hardball. I wonder how current law interprets and punishes such practices if there exists undeniable evidence of wrongdoing. Remember sockpuppets? Srajan
